Delivery and fees


  • Shipping and packaging are subject to the judgment of the seller taking their responsibilities into account.
  • The products and packaging delivered will only be marked in accordance with the German requirements.
  • The risk is transferred to the customer at the latest when the delivery item is handed to the the shipper, carrier or other third party tasked with making the shipment (the start of the loading process is the relevant moment in time here).
  • The provisions of paragraph 3 also apply if there is a partial shipment or where the seller has taken on other services in addition.


  • Deliveries are made ex works.
  • Any dates and deadlines proposed by the seller for the delivery and services are always only approximations, unless a fixed deadline or date has been agreed or promised expressly. If the goods are to be sent by a third-party shipper, any dates and deadlines for delivery refer to the time when the goods are handed over to the carrier, freight forwarder or other third-parties responsible for the transportation.
  • The seller is not liable for impossibility of delivery or for delays in delivery if these are caused by force majeure or other events that could not be foreseen at the time the contract was concluded (e.g. operational disruptions of all kinds, difficulties in procuring the material or being supplied with energy, transport delays, strikes, lawful lockouts, shortage of labor, energy or raw materials, difficulties in obtaining the required approvals from the regulatory agencies, or missing, wrong or late deliveries by suppliers) for which the seller is not responsible. Exceptions only apply if the seller is responsible for the respective occurrence.
  • If the events specified in paragraph 3 substantially complicate the delivery or service or make it impossible for the seller and the hindrance is not just of a temporary nature, the seller is entitled to withdraw from the contract. With hindrances of a temporary nature, the delivery or service provision deadlines may be extended or the delivery or service dates may be shifted by the period of the delay plus a reasonable start-up period. Insofar as the purchaser is unable to accept the delivery of goods or services as agreed due to these delays, they may withdraw from the contract by means of an immediate written notification made to the seller.
